Car Accident: The State Claims Damages as Constance

The road accident rises to 3 June 2002. Both vehicles, GM 8755 and registered 242 AP 92, collided with Rich-Fond. According to the complaint written by the Chief State Attorney, the driver of the car owned traveling towards Quartier-Militaire and had to go to Lallmatie. 

At height of the temple in Tamil Rich-Fond, the driver spotted a vehicle who was traveling in the opposite direction. The vehicle had forsaken his way to roll backwards. According to the complaint, the driver of the car of the state did its best to avoid being hit. In vain. 

According to the Chief State Attorney, the accident is due to the fault and negligence of Henry Maxwell Carver, driver of the car belonging to Constance Hotels Services Limited. In its complaint, the State had indicated that the crashed car was unusable for 40 days due to repairs. 

March 31, 2012, the State had then serve a notice of Constance Hotels Services Limited and Swan Insurance Company Limited for they claim a sum of Rs 530,000. The state expected the payment of that sum within two weeks. Both companies have however been no response. The Chief State Attorney alleges in the complaint, not being able to serve a notice to Henry Maxwell Carver because it was not found. 

In response, the State appealed to the Supreme Court and led his claim against Constance Hotels Services Limited, Swan Insurance Company Limited and Henry Maxwell Carver. The State also claims a 15% interest on the damages he would get.
