Hurrynarain Unoruth, a receiver, lost his case he was instituting his former employer, the National Transport Corporation (NTC). He sued for wrongful dismissal the NTC, and had demanded the sum of Rs 637 018.93.

In his judgment, Judge Ratnaa Seetohul-Toolsee argues that the NTC "has been Proved That balance of probabilities the plaintiff's (Hurrynarain Unoruth) WAS Justified dismissal." For this reason, it rejected the request for Hurrynarain Unoruth.

While the lawyer of the complainant referred in his argument, that the NTC could not prove "there was balance of probability" that the dismissal of his client was justified. The magistrate Ratnaa Seetohul-Toolsee is not of that opinion. It highlights that Hurrynarain Unoruth has a long list of "Disciplinary records", and he had several opportunities to repent. But he did not.

Hurrynarain Unoruth NTC had joined the company in September 1987. However, 26 February 2008, he was sacked, after facing a disciplinary committee for "gross misconduct".

As defense Hurrynarain Unoruth supports a controller made a false statement against him, the police station in Baie-du-Cap. However, there has been no prosecution by the police, but he was suspended by the NTC for six days. Furthermore, he claims that his two brothers were also dismissed from the NTC, due to frivolous complaints, and also a complaint filed by the same controller.

Hurrynarain Unoruth advance that he was the victim of conspiracy and vendetta by staff of the NTC. He maintains that he was discriminated against him, and he faced a disciplinary committee under four counts.

For its part, the NTC says it has fired Hurrynarain Unoruth after the conclusion of the disciplinary committee. It highlights qu'Hurrynarain Unoruth had a "fair trial" and that the charges against him have been established for "gross misconduct".
