Dev Prakash Mahadeo, a resident of La Flora, had initiated civil proceedings before the Industrial Court against his employer, the National Transport Corporation (NTC) for wrongful dismissal. The Order of the trial, counsel for the NTC, Jean Gilbert Ithier, Senior Counsel, stated that the NTC and the complainant (Dev Prakash Mahadeo) came to an agreement.

Thus, counsel noted that the NTC offered the sum of Rs 50,000 to the complainant "in full and final satisfaction."

The complainant alleged that his dismissal was unjustified because the NTC has committed an obstacle to Article 38 (2) (a) (iii) of the Employment Rights Act by failing to notify him of the charges against him are in within 10 days.
